These Trade Program Terms & Conditions (“Terms”) apply to approved trade customers purchasing from Bayside Luxe (“Bayside Luxe”, “we”, “us”, “our”).
By applying for or using a trade discount code, you agree to these Terms.
1. Definitions
Trade Customer means a business approved by Bayside Luxe for access to trade benefits.
Trade Pricing means discounted pricing not available to the public.
Goods means products supplied by Bayside Luxe.
Project means the job or development into which the Goods are incorporated.
Special Order / Made to Order means products not ordinarily stocked or manufactured specifically for a Project.
2. Eligibility & Approval
Trade access is available to builders, cabinet makers, joiners, shopfitters, developers and other industry professionals holding a valid ABN.
Approval is at the sole discretion of Bayside Luxe. We may refuse, suspend or cancel trade access at any time.
3. Trade Discount Code Use
Approved customers are issued a unique trade discount code.

4. Permitted Use
Trade Pricing is provided solely for incorporation of Goods into Projects.
Trade Pricing must not be:
Trade discounts cannot be combined with public promotions or sale pricing unless approved in writing.
5. Confidentiality
Trade Pricing, discount structures and project quotations are confidential commercial information and must not be disclosed.
6. Quotes
Quotes are valid for 30 days unless otherwise stated.
After this time, pricing and availability may change.
Lead times are estimates only.
7. Orders & Payment
Payment is required in full prior to dispatch.
Bayside Luxe may delay or cancel supply where payment has not been received.
8. Product Availability
All orders are subject to stock availability.
We reserve the right to withdraw or change products without notice.
9. Delivery & Risk
Delivery occurs when Goods arrive at the nominated address, whether attended or unattended.
Risk passes to the customer upon delivery.
We may dispatch orders in instalments or split shipments.
10. Inspection on Delivery
Goods must be inspected immediately upon receipt.
Claims for damage, shortage or incorrect supply must be submitted within 48 hours of delivery and must include photographic evidence.
Claims outside this timeframe may not be accepted.
11. Returns – Firm Sale
All Trade purchases are firm sale.
We do not accept returns for change of mind, ordering error, over-ordering or project variation.
Where Goods are faulty or incorrectly supplied, remedies will be provided in accordance with the Australian Consumer Law.
12. Special Order / Made to Order
Special Order and Made to Order Goods cannot be cancelled or returned except where required by law.
13. Installation & Suitability
The Trade Customer is responsible for verifying measurements, finishes, function and suitability before ordering and installation.
14. Warranty & Australian Consumer Law
Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Additional manufacturer warranties may apply where stated.
15. Limitation of Liability
To the maximum extent permitted by law, Bayside Luxe is not liable for indirect or consequential loss, project delay, loss of profit, or reinstallation costs.
16. Force Majeure
Bayside Luxe is not responsible for delays or failures caused by events beyond reasonable control including supplier disruption, freight delays or natural events.
17. Marketing & Project Images
Where Bayside Luxe products are installed, and unless agreed otherwise in writing, the Trade Customer grants Bayside Luxe permission to use project photography or video for marketing and promotional purposes.
18. Suspension or Termination
Trade access may be withdrawn immediately for misuse, non-payment or breach of these Terms.
19. Amendments
We may update these Terms at any time. Continued purchasing constitutes acceptance.
20. Governing Law
These Terms are governed by the laws of Victoria, Australia.
